Free Software Application and Use Agreement
1. 定義與解釋/ Definitions and Interpretations
社區版：指適用于個人用戶的免費軟件版本。
Community Edition: Refers to the free software version of the software for individual users.
商業版：指適用于公司用戶的免費軟件版本。
Business Edition: Refers to the free software version of the software for corporate users.
2. 用戶信息與隱私/ User Information and Privacy
在申請軟件時，用戶需提供相關個人或公司信息。用戶有責任確保所提供的信息真實、準確并保持最新。如本公司發現用戶提供虛假信息，本公司有權采取適當措施，包括但不限于暫停或終止用戶的軟件使用權，并不承擔任何責任。
When applying for the software, users must to provide relevant personal or company information. Users are responsible for ensuring that the information they provide is true, accurate, and up-to-date. If our company discovers that a user has provided false information, we reserve the right to take appropriate action, including but not limited to suspending or terminating the user's right to use the software, and shall not be held responsible for any consequences.
本公司將根據相關法律法規保護用戶的個人信息安全，不會未經用戶同意向第三方披露用戶的個人信息。但在法律要求或不可抗力情況下，本公司可能無法履行此項義務。
Our company will protect the security of users' personal information in accordance with relevant laws and regulations, and will not disclose users' personal information to third parties without their consent. However, due to legal requirements or force majeure circumstances, our company may not be able to fulfil this obligation.
用戶同意本公司有權根據業務需要，使用用戶的信息進行內部數據分析、改進產品和服務、聯系用戶等活動，但保證不會違反相關法律法規的規定。
Users agree that our company has the right to use their information for internal data analysis, product and service improvement, contacting users, and other activities necessary for our business, while ensuring compliance with relevant laws and regulations.
3. 軟件許可及使用/ Software License and Usage
用戶根據本協議的規定，有權使用社區版或商業版軟件。
According to the provisions of this Agreement, users have the right to use either the Community Edition or Business Edition software.
社區版軟件僅適用于個人用戶，且不得用于任何形式的、用于獲取商業利益的活動。
The Community Edition software is only applicable to individual users, and may not be used for any activities aimed at obtaining commercial benefits.
商業版軟件適用于公司用戶。本公司將不定期、有條件地免費提供商業版軟件。
The Business Edition software is applicable to corporate users. Our company will provide the Business Edition software for free from time to time and under certain conditions.
4. 技術支持與服務/ Technical Support and Services
本公司將通過 www.xyda.cc（以下簡稱“問答平臺”）為社區用戶和商業用戶提供技術支持。對于客戶提出的技術支持請求，我們將盡快回復，但不承諾具體響應時間。
Our company will provide technical support for both community and business users through www.xyda.cc (hereinafter referred to as the "Q&A platform"). We will respond to technical support requests from customers as soon as possible, but we do not commit to a specific response time.
本公司將為每一個社區版用戶提供一個問答平臺的賬號。根據商業版客戶的需求，本公司將提供一定數量的問答平臺賬號。
Our company will provide one Q&A platform account for each Community Edition user. According to the needs of Business Edition customers, our company will provide a certain number of Q&A platform accounts.
5. 知識產權與保密/ Intellectual Property Rights and Confidentiality
用戶同意尊重本公司的知識產權，并承諾不將本公司的軟件用于侵犯他人的知識產權的行為。
Users agree to respect our company's intellectual property rights and commit not to use our software to infringe on the intellectual property rights of others.
用戶同意在使用本公司軟件產生的數據用于公開發表的論文、學術成果等情況下，需在成果公開發表前通知本公司。
Users agree to notify our company before publicly publishing any papers or academic achievements that use data generated by our software.
6. 合規性與責任限制/ Compliance and Liability Limitation
用戶同意不將本公司的軟件用于研發殺傷性武器或任何威脅人類和平的活動，以及違反用戶所在國家相關法律法規的產品研發、技術研究或任何技術活動。
Users agree not to use our company's software for the research and development of lethal weapons or any activities that threaten human peace, as well as any product development, technical research, or technical activities that violate the relevant laws and regulations of the user's country.
本公司產品經過完整的設計和流片驗證。但考慮到設計的復雜性以及用戶的水平差異，對于使用本公司軟件造成的產品開發、流片故障或損失，本公司將協助用戶解決問題，但不承擔任何責任。亦不保證免費版與付費版功能完全相同。
Our company's products have undergone complete design and tape-out verification. However, considering the complexity of the design and the differences in user expertise, for any product development failures or losses caused by the use of our software, our company will assist users in resolving the issues but shall not be held responsible. There is no guarantee that the free version will have exactly the same functionality as the paid version.
7. 升級維護與生態積分/ Upgrades, Maintenance, and Ecosystem Points
社區版軟件包含永久升級維護。商業版軟件包含自激活之日起12個月內的升級維護。
The Community Edition software includes permanent upgrades and maintenance. The Business Edition software includes upgrades and maintenance within 12 months from the date of activation.
我們將為社區版用戶提供生態積分，用戶可通過使用軟件從事開發和研究工作、反饋軟件漏洞、改進建議、介紹用戶、協助整理軟件應用案例、協助整理軟件幫助文檔等活動獲取生態積分。本公司負責制定生態積分的發放規則并享有此規則的最終解釋權。
We will provide ecosystem points for Community Edition users. Users can earn ecosystem points by using the software for development and research, reporting software bugs, providing improvement suggestions, introducing new users, assisting in organizing software application cases, assisting in organizing software help documentation, and other activities that enhance the value of the software. Our company is responsible for formulating the rules for issuing ecosystem points and has the final interpretation of these rules.
8. 不可抗力免責/ Force Majeure Exemption
本公司在遭受不可抗力事件（如戰爭、恐怖主義行為、罷工、自然災害等）時，無法履行本協議的相關義務，對用戶造成的損失，本公司不承擔任何責任。
Our company shall not be held responsible for any losses to users if it is unable to fulfill its obligations under this Agreement due to force majeure events (such as war, terrorism, strikes, natural disasters, etc.).
9. 其他/ Other Provisions
本公司保留對本協議條款的最終解釋權。本協議的修改及更新將在本公司官方網站上公示，并自公示之日起生效。
Our company reserves the right to the final interpretation of the terms of this Agreement. The amendments and updates to this Agreement will be posted on our official website and will take effect from the date of the announcement.
如果本協議的任何條款被認為無效或無法執行，該條款應視為可分割的，且不影響其他條款的有效性和可執行性。
If any provision of this Agreement is deemed invalid or unenforceable, such provision shall be considered severable and shall not affect the validity and enforceability of the remaining provisions.
